6.Intellectual property
6.1All content on the website, including texts, images and logos, is the property of ADHD Medisch Centrum and may not be used without permission.
6.2Copying or distributing materials is only permitted with express written permission.
7.Privacy and data protection
7.1Personal data are treated confidentially in accordance with the General Data Protection Regulation (GDPR, in Dutch: AVG). See our privacy statement for more information.
7.2ADHD Medisch Centrum ensures appropriate security measures to protect your data against unauthorised access.
8.Liability and damage
8.1The provisions of the Medical Treatment Contracts Act (Wet op de geneeskundige behandelingsovereenkomst, Title 7.7.5 of the Dutch Civil Code) apply to the treatment agreement. ADHD Medisch Centrum does not exclude or limit its liability for shortcomings in the performance of the treatment agreement.
8.2ADHD Medisch Centrum is the client's point of contact for damage that has arisen in the performance of the treatment agreement, regardless of which healthcare provider involved in the treatment committed the shortcoming. ADHD Medisch Centrum has taken out liability insurance for this.
8.3The client provides ADHD Medisch Centrum, to the best of their knowledge, with the information and cooperation reasonably required for the performance of the treatment agreement, and reports changes in their situation that may be relevant to the treatment. Damage resulting from that information not being provided, not being provided in time or being provided incorrectly is borne by the client, insofar as the law permits.
8.4An incident that has or may have noticeable consequences for the client is discussed with the client as soon as possible. ADHD Medisch Centrum informs the client of the nature and cause of the incident and of the measures that have been taken to prevent it from happening again, and records this in the file.
8.5The client is responsible for their own personal belongings during a visit to the locations of ADHD Medisch Centrum. The client is liable for damage they cause to property of ADHD Medisch Centrum, its staff or other clients.
8.6The information on the website of ADHD Medisch Centrum is general in nature and does not replace individual medical advice. A treatment relationship only arises by concluding a treatment agreement.
9.Complaints and disputes
9.1ADHD Medisch Centrum has a complaints procedure that complies with the Healthcare Quality, Complaints and Disputes Act (Wet kwaliteit, klachten en geschillen zorg, Wkkgz). Complaints can be submitted by email to klachtenfunctionaris@adhdmc.nl. When submitting and formulating a complaint, the client can be assisted free of charge by the independent complaints officer of the Klachtenloket Zorg (opens in a new window) (Healthcare Complaints Desk, in Dutch).
9.2The client receives a written and reasoned decision within six weeks of receipt of the complaint. If careful investigation requires this, this period may be extended once by four weeks; the client will be informed of this before the first period expires.
9.3If the complaint is not resolved to the client's satisfaction, the client can submit the dispute to the Geschillencommissie Zorg Algemeen (General Healthcare Disputes Committee, www.degeschillencommissiezorg.nl (opens in a new window), in Dutch), the recognised disputes body to which ADHD Medisch Centrum is affiliated.
10.Cancellation and termination of services
10.1Clients can terminate the agreement at any time by giving written notice. Any outstanding payments remain due.
10.2ADHD Medisch Centrum can only terminate the treatment agreement if there are serious reasons for doing so (Article 7:460 of the Dutch Civil Code), such as:
- aggression, threats or other seriously inappropriate behaviour towards staff or other clients;
- repeatedly failing to keep appointments or meet obligations, after the client has been spoken to about this;
- the absence of a referral or of funding for the care;
- a care need for which ADHD Medisch Centrum cannot provide appropriate care.
10.3ADHD Medisch Centrum discusses a termination with the client in advance, observes a reasonable period of notice and, where necessary, helps in finding appropriate follow-up care.
11.Changes to the general terms and conditions
11.1ADHD Medisch Centrum reserves the right to amend these general terms and conditions.
11.2Changes are announced on the website at least one month before they take effect. For ongoing treatments, amended terms and conditions only apply insofar as they do not disadvantage the client.
12.Force majeure
12.1If an appointment cannot go ahead due to circumstances beyond the control of ADHD Medisch Centrum, ADHD Medisch Centrum will inform the client as soon as possible and a new appointment will be made in consultation. No costs are charged for this.
12.2This article is without prejudice to Article 8.1.
13.Applicable law and disputes
13.1These general terms and conditions are governed by Dutch law.
13.2Disputes are preferably resolved by mutual consultation. The client can submit a dispute to the disputes committee referred to in Article 9 or to the civil court: the District Court of Amsterdam (rechtbank Amsterdam), the place where ADHD Medisch Centrum is established, or another court that has jurisdiction under the law. A claim by ADHD Medisch Centrum against the client is submitted to the court of the client's place of residence.
